By accessing or using our AI-powered digital identity generation platform (operating under the official name "Digital Twin", as well as references including "The Twin App" and "Digital Twinz", operated by Bluespark Industries LLC, hereinafter "Digital Twin", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By creating an account or using Digital Twin (or any associated websites, apps, or services), you agree to these Terms and our Privacy Policy. If you do not agree, you may not use our services.

2. Description of Service

Digital Twinz provides AI-powered image and video generation services that create consistent digital portraits based on reference images you provide. Our service includes:

AI-generated images maintaining identity consistency
Video generation for eligible subscription tiers
Cloud storage for your generations
Public and private sharing options

3. Account Registration

You must provide accurate information when creating an account
You are responsible for maintaining the security of your account
You must be at least 13 years old to use our service
One person may not maintain multiple free accounts

4. Subscription & Billing

Subscription Tiers: Free, Standard ($10/mo), Premium ($25/mo), Creator Pro ($100/mo), and Business Pro ($250/mo). Each tier includes different credit allocations and features as described on our pricing page.

Paid subscriptions are billed monthly in advance
Credits reset daily at midnight UTC
Unused credits do not roll over
You may cancel your subscription at any time
Refunds are provided at our discretion

5. Acceptable Use

You agree NOT to use Digital Twin (or any affiliated services, domains, or aliases including The Twin App and Digital Twinz) to:

Generate content depicting minors
Create non-consensual intimate imagery
Impersonate others for fraudulent purposes
Generate illegal, harmful, or harassing content
Violate any applicable laws or regulations
Attempt to bypass usage limits or security measures

Violation of these rules may result in immediate account termination without refund.

6. Content Ownership & Rights

Your Content: You retain ownership of reference images you upload
Generated Content: You own the AI-generated images created from your references
License to Us: You grant us a license to process and store your content as needed to provide the service
Public Sharing: Content you mark as public may be displayed on our platform

7. Intellectual Property

The Digital Twinz platform, including its design, code, and features, is our proprietary property. You may not copy, modify, or create derivative works from our platform.

8. Disclaimers

AI generation results may vary and are not guaranteed
The service is provided "as is" without warranties of any kind
We do not guarantee uninterrupted or error-free service
We are not liable for content you create or how you use it

9. Limitation of Liability

To the maximum extent permitted by law, Digital Twinz shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

10. Termination

We may suspend or terminate your account at any time for violation of these Terms. Upon termination, your right to use the service ceases immediately.

11. Changes to Terms

We may modify these Terms at any time. Continued use of the service after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
